Following the discovery phase, there is the deposition phase. Much like the discovery phase, this is an exchange of information, only face-to-face.  Depositions are videotaped interviews of all relevant parties involved including the truck driver, police, expert and eye witnesses and all victims.

Much like the discovery phase, this can take some time.  Since depositions must be videotaped, the logistics of getting everyone involved in front of a video camera can be difficult and time consuming.

Mediation, Settlements and More

Once discovery is completed, both sides will normally take some time to evaluate the collected information. All parties have the information needed to make an informed decision on the case.

Normally, our firm will present them with what we feel is a fair settlement amount.  This includes medical bills, lost wages, rehabilitation costs, loss of future earnings, pain and suffering, and any other bill or costs related to the truck wreck. Is often at this point that the case goes to mediation.

Mediation is when both sides meet with an agreed-upon third party mediation who will try to get both sides to come to an agreement. Most cases are settled during mediation because this helps everyone avoid a time-consuming and costly trial.
