Recently, a jury awarded a family from El Paso, Texas more than $4 million dollars after they filed a lawsuit against three different trucking companies. Lorenzo Munoz and Robert Franceware were killed in a 2010 18 wheeler truck wreck. The truck crashed into a concrete pillar, an embankment, and then caught on fire. According to the suit the three companies gave Munoz and Franceware deadlines and schedules that forced Munoz to drive even though he was too tired to get behind the wheel. The suit also stated that Munoz hadn’t been trained properly by the three trucking companies to drive the truck. The suit found all three trucking companies negligent, however, a defense attorney for one of the trucking companies did state that they were found “the least negligent”.
Stories like these are perfect examples of what happens when proper care, training, and adequate rest isn’t given to drivers of 18-wheelers. The story above could have turned out quite differently. Other people on the road at the time could have also been severely injured, and even killed. There are so many factors involved when an accident such as this one happens. The trucking companies were all involved and were sued equally for their negligence when they failed to properly train their driver, and then set the drivers out on a schedule that was impossible to keep up with unless they got the proper amount of rest. These companies had their own agenda in mind, and that was making money. They intentionally chose to ignore the consequences that would unfold when this driver got into his truck and simply began to do the job he was told to do. Mr. Munoz leaves behind a wife and three children. This is why it is so important to hire a Dallas truck accident attorney when you are in an accident with an 18-wheeler, or even driving an 18-wheeler.
These companies have been held accountable for their negligence and a jury saw fit to award Mr. Munoz family a settlement that will help them, especially since Mr. Munoz was the breadwinner of the family.
