Texas is currently one of nine states that does not ban all drivers from texting while behind the wheel. However, Texas does ban novice drivers and school bus drivers from using cell phones (including texting) while operating a motor vehicle.

According to the 2013 report Distracted Driving: GHSA Survey of the States, this lack of a single law that specifically bans all drivers from texting is one of the major obstacles faced by the state when it comes to enforcing distracted driving. The survey also indicates that Texas has a lack of funding for distracted driving education and enforcement.

Texas is one of a growing group of states to collect data related to distracted driving in its accident reports. Crash reports in Texas note driver distraction in vehicle, driver inattention and cell phone use.

Cell phone use and texting have proven especially dangerous to teen drivers. A recent review of data by the Cohen Children’s Medical Center shows that texting has surpassed drinking as the leading cause of fatal car accidents involving novice drivers.
