You may not be out of luck. If you have Uninsured Motorist benefits (commonly called UM coverage) on your own insurance policy, you can make a claim against your own insurance company for your damages. Further, if you have Personal Injury Protection (“PIP”) or Medical Payments coverage on your own policy, you can recover some damages under those coverages as well. Under PIP, you can recover your medical expenses and lost wages, up to your coverage limit. Under Medical Payments coverage, your can only recover your medical expenses up to the available limit.
